Cosby accuser to resume testimony in sex assault trial

Cosby is charged with three counts of aggravated indecent assault for allegedly drugging and sexually assaulting Andrea Constand in 2004.

Cosby, for years feted by millions as "America's Dad" for his role as a lovable obstetrician and father on "The Cosby Show", says he is now legally blind.

But the 44-year-old Constand brushed aside the broadsides like a courtroom pro, the Philadelphia Daily News reports.

The criminal case was reopened in 2015 after a judge unsealed Cosby's civil deposition, in which the entertainer admitted to having given sedatives to young women he was romantically interested in.

"I wasn't able to fight him away", she added on the second day of Cosby's trial.

Prosecutors said phone records show a consistent pattern of Constand checking her voicemail and then calling Cosby in the two months after the alleged January 2004 assault.

He's maintained that his sexual contact with Constand was consensual.

"I think because I was new, I was a Canadian person in a new city, with a new job". To hear her talk about something I never heard her talk about, to see her cry, was really hard for me.

In Tuesday's testimony, Constand described how her professional relationship with Cosby evolved into a friendship.

"Yes", replied Constand, though she said the bath salts were not from her, but from a friend. I felt really humiliated. At the same time, Constand said, she was bringing Cosby a gift from a mutual acquaintance. Somebody that I trusted.

Constand said Cosby gave her pills he claimed were a natural remedy to ease her stress about a looming career change.

The newspaper does not normally identify victims of sex crimes without their consent but is using Constand's name because she has identified herself publicly. "I said, 'What are they?" "Put 'em down, they're your friends".

"Tell the truth", Constand said.

The prosecution and defense questioned why Constand waited a year before reporting the alleged assault to police and met with lawyers before going to law enforcement.

About half an hour later, Constand said, she had trouble talking and difficulty moving and was suffering double vision.

"It had more to do with business than it did with me personally", she said.

Cosby turned toward the voice and said, "Happy Birthday". "I thought Mr. Cosby would try to retaliate and hurt me".

"It was a very big burden on me, but ..." She panicked when she tried to move her legs, realizing she couldn't get up. "I was in no state of mind". She clarified today that Cosby had called and invited her to his Pennsylvania house for dinner. She passed out, she told the court, and when she came to, Cosby was groping her breasts and genitals. Johnson said that she had lotion on her hand and Cosby made her touch his penis, she said.

"I wasn't able to", Constand said.

The defense questioned Constand's credibility pointing to phone records after the incident showing she called Cosby the same morning she contacted lawyers. "So I went along with it".

However, the next time she visited the actor's home she alleges he gave her three pills that he called herbal supplements.

Constand, an athletic 6-footer with dark curly hair, was calm and collected as she testified, looking at the jury as she began describing the assault.

She said she didn't have the courage to tell her family what happened, but that it was a burden. "I was on my way home".

Cosby's defense attorney, Brian McMonagle, staunchly denied all accusations presented against his client on Monday, and presented the case that the claims made about Cosby were patently false.
